I understand why you are unhappy with our conclusion, and I appreciate that you are raising what you consider to be a contradiction between the Responsible Gambling policy and the specific self-exclusion procedure. We certainly do not want to dismiss the seriousness of what you communicated to the casino. However, there is an important distinction here.
Section 2.1 states that SilverPlay applies active measures to prevent the negative consequences associated with excessive gambling behavior after consulting with the client. It does not state that the casino must immediately close or suspend an account upon any communication mentioning gambling difficulties, nor does it state that the casino must process such a request outside of the specific self-exclusion procedure set out in its Terms.
The self-exclusion provision is quite explicit: the player must send the self-exclusion request to the designated email address, customercare@silverplay.com, and the casino states that it may take up to 10 business days to action the request. Nowhere in the provision does it say that the account will be closed immediately upon the first communication, regardless of where that communication is sent.
We fully understand your argument that 10 business days is a long period, particularly when a player has clearly expressed concerns about their gambling. We agree that this is something worth bringing to the casino's attention, however, we are unable to require them to refund your deposits or override their stated procedure as we cannot dictate the casino's Responsible Gambling procedures or decisions.
It is also important to remember that the Terms and Conditions, including the Responsible Gambling and self-exclusion provisions, are available to the player and are accepted when registering with the casino. The applicable procedure therefore forms part of the conditions under which the account is operated, and it is ultimately the player's responsibility to follow the stated procedure when submitting a formal self-exclusion request.
That does not mean we are dismissing your concerns. We acknowledge that the 10-business-day timeframe may be excessive and that the circumstances deserve to be raised with the operator. We are willing to contact SilverPlay regarding the handling of your case, but we want to be transparent that we cannot guarantee a particular outcome or compel the casino to provide compensation where we cannot establish a breach of its published terms.

We willen de ernst van uw mededeling aan het casino zeker niet bagatelliseren. Er is hier echter een belangrijk verschil.
Paragraaf 2.1 stelt dat SilverPlay, na overleg met de klant, actieve maatregelen neemt om de negatieve gevolgen van excessief gokgedrag te voorkomen. Hierin staat niet dat het casino een account onmiddellijk moet sluiten of opschorten na een melding van gokproblemen, noch dat het casino een dergelijk verzoek buiten de specifieke zelfuitsluitingsprocedure zoals beschreven in de Algemene Voorwaarden moet verwerken.
De bepaling inzake zelfuitsluiting is zeer expliciet: de speler moet het verzoek tot zelfuitsluiting naar het daarvoor bestemde e-mailadres sturen, customercare@silverplay.com , en het casino geeft aan dat het tot 10 werkdagen kan duren om het verzoek te verwerken. Nergens in de bepaling staat dat het account onmiddellijk wordt gesloten na de eerste communicatie, ongeacht waar die communicatie naartoe wordt gestuurd.
We begrijpen uw argument volledig dat 10 werkdagen een lange periode is, vooral wanneer een speler duidelijk zijn zorgen heeft geuit over zijn gokgedrag. We zijn het ermee eens dat dit iets is om onder de aandacht van het casino te brengen. We kunnen hen echter niet verplichten uw stortingen terug te betalen of hun vastgestelde procedure te negeren, aangezien we de procedures of beslissingen van het casino met betrekking tot verantwoord gokken niet kunnen dicteren.
Het is ook belangrijk om te onthouden dat de algemene voorwaarden, inclusief de bepalingen over verantwoord gokken en zelfuitsluiting, beschikbaar zijn voor de speler en worden geaccepteerd bij registratie bij het casino. De toepasselijke procedure maakt daarom deel uit van de voorwaarden waaronder het account wordt beheerd, en het is uiteindelijk de verantwoordelijkheid van de speler om de vermelde procedure te volgen bij het indienen van een formeel verzoek tot zelfuitsluiting.
Dat betekent niet dat we uw zorgen negeren. We erkennen dat de termijn van 10 werkdagen wellicht te lang is en dat de omstandigheden het waard zijn om met de operator te bespreken. We zijn bereid contact op te nemen met SilverPlay over de afhandeling van uw zaak, maar we willen transparant zijn en aangeven dat we geen specifieke uitkomst kunnen garanderen of het casino kunnen verplichten tot compensatie als we geen schending van de gepubliceerde voorwaarden kunnen aantonen.
